The Constitutional Court has granted an injunction staying disciplinary and interdiction proceedings against May Pen Hospital doctor Aujae Dixon, revoked the decision to place him on interdiction, and cleared the way for him to resume duties while his constitutional challenge to the Staff Orders moves forward.
The orders granted on Tuesday by Justice T Hutchinson Shelly, sitting in Chambers in the Constitutional Court, will remain in effect until Dr Dixon’s claim is determined.
Dr Dixon had been interdicted by his employer, the Southern Regional Health Authority (SRHA), following his participation as a candidate in the General Election on Wednesday, September 3. The SRHA alleges that his candidacy breached the Staff Orders for the Public Service.
In his constitutional claim, Dr Dixon argues that the provisions of the Staff Orders used against him are unlawful and should be struck down, asserting that they violate several fundamental rights guaranteed under the Charter of Fundamental Rights and Freedoms.
With Tuesday’s ruling, Dr Dixon is now able to return to work at the May Pen Hospital as the case progresses. The Constitutional Court is set to hear the substantive claim on January 22, 2026.
Dr Dixon is represented by Kwame Gordon and Maurice McCurdy, while Jenoure Simpson represents the Director of State Proceedings and Karlene McFarlane-Richards appears for the Southern Regional Health Authority.
